CONDITIONS DE LA VENTE
= La participation aux enchères implique l’acceptation inconditionnelle des présentes conditions de vente.
= Elle est faite au comptant. Les acquéreurs paieront en sus de l’adjudication, le prix
principal augmenté des frais légaux : 23% H.T. (27,6% T.T.C.)
= Les clients non résidents en France ne pourront prendre livraison de leur achat qu’après
un règlement bancaire par télex ou SWIFT.
= La livraison de l’objet pourra être différée jusqu’à l’encaissement du chèque ou du virement.
= Il est conseillé aux adjudicataires de procéder à un enlèvement de leurs lots dans les
meilleurs délais afin d’éviter les frais de manutention et de gardiennage qui sont à leur charge.
= Le magasinage n’engage pas la responsabilité du commissaire-priseur à quelque titre
que ce soit. Les adjudicataires pourront obtenir tout renseignement concernant la livraison
et l’expédition de leurs acquisitions à la fin de la vente.
= Une exposition préalable permettant aux acquéreurs de se rendre compte des biens mis en
vente, il ne sera admis aucune réclamation une fois l’adjudication prononcée. Sur demande,
avant la vente, un “condition report” descriptif sera communiqué.
= Les acquéreurs potentiels sont invités à examiner les biens pouvant les intéresser avant
la vente aux enchères, et notamment pendant les expositions. L’Etude Joron-Derem se tient
à la disposition des acquéreurs potentiels pour leur fournir des rapports sur l’état des lots.
= Les descriptions des lots résultant des catalogues, des rapports, des étiquettes et des
indications ou annonces verbales ne sont que l’expression par L’Etude Joron-Derem de sa
perception du lot, mais ne sauraient constituer la preuve d’un fait.
= Les indications données par L’Etude Joron-Derem sur l’existence d’une restauration, d’un
accident ou d’un incident affectant le lot, sont exprimées pour
faciliter son inspection par l’acquéreur potentiel et restent soumises à son appréciation
personnelle ou à celle de son expert. L’absence d’indication d’une restauration, d’un accident
ou d’un incident dans le catalogue, les rapports, les étiquettes ou verbalement, n’implique
nullement qu’un bien soit exempt de tout défaut présent, passé ou réparé. Inversement la
mention de quelque défaut n’implique pas l’absence de tous autres défauts.
= La vente est réglée par les garanties en vigueur des Commissaires-Priseurs français à la
date de la vacation. Les dimensions et poids ne sont donnés qu’à titre indicatif. Les réparations
d’entretien ne sont pas signalées. Aucune réclamation n’est acceptée quant à l’état sous la
dorure, la peinture, les laques ou les vernis.
Les rentoilages, parquetages et vernissages sont considérés comme des mesures de conservation.
= Réserve étant également faite pour les clés, serrures, bronzes, ferrures qui auraient été
remplacés à une époque indéterminée et qui ne sont pas garantis.
= Le plus offrant et le dernier enchérisseur sera l’adjudicataire.
= Le Commissaire-priseur et les Experts se chargent d’exécuter tous les ordres d’achat qui
leur sont confiés, en particulier pour les amateurs ne pouvant assister à la vente.
= Dans l’impossibilité de se rendre à la vente, un acheteur peut confier un ordre d’achat à
l’étude. L’étude décline toute responsabilité quant à l’exécution des ordres d’achat.
= Si vous souhaitez enchérir par téléphone, veuillez en faire, au plus tard deux jours avant la vente,
la demande par écrit ou par fax accompagnée d’un chèque libellé à l’ordre de l’étude Joron-Derem.
= Dès adjudication, l’objet sera sous l’entière responsabilité de l’adjudicataire.
= L’acquéreur sera lui-même chargé de faire assurer ses acquisitions et l’étude Joron-Derem
décline toute responsabilité quant aux dommages que l’objet pourrait encourir et ceci dès
l’adjudication prononcée. La formalité de licence d’exportation peut requérir un délai de 5
à 10 semaines, celui-ci pouvant être sensiblement réduit selon la rapidité avec laquelle
l’acquéreur précisera ses instructions à l’étude Joron-Derem.
= Tout enchérisseur est censé agir pour son propre compte sauf dénonciation préalable de sa
qualité de mandataire pour le compte d’un tiers, acceptée par la SARL Christophe JORON-DEREM.
= Tout acquéreur de l’Union européenne, identifié à la TVA, doit, au moment de la vente,
indiquer son numéro d’identification en vue d’une livraison intracommunautaire justifiée
par l’expédition vers l’autre Etat membre et dispose de trente jours pour régulariser.
= L’acquéreur non communautaire doit signaler, lors de la vente, son intention d’exporter et
dispose de 30 jours pour faire parvenir les justificatifs de l’exportation.
= Le Commissaire-Priseur décline toute responsabilité sur les conséquences juridiques et
fiscales d’une fausse déclaration de l’acquéreur.
= L’adjudicataire reconnaît :
= Devenir propriétaire et responsable des lots dès adjudication.
= Assumer les risques et frais de la manutention et du magasinage.
= La délivrance de lots ne se fait qu’après encaissement des fonds.
= Les acquéreurs potentiels sont invités à examiner les biens pouvant les intéresseravant
la vente aux enchères, et notamment pendant les expositions. L’Etude Joron-Derem se tient
à la disposition des acquéreurs potentiels pour leur fournir des rapports sur l’état des lots.
= Les descriptions des lots résultant du catalogue, des rapports, des étiquettes et des
indications ou annonces verbales ne sont que l’expression par L’Etude Joron-Derem de sa
perception du lot, mais ne sauraient constituer la preuve d’un fait.
= Les indications données par L’Etude Joron-Derem sur l’existence d’une restauration, d’un
accident ou d’un incident affectant le lot, sont exprimées pour faciliter son inspection par
l’acquéreur potentiel et restent soumises à son appréciation personnelle ou à celle de son
expert. L’absence d’indication d’une restauration d’un accident ou d’un incident dans le
catalogue, les rapports, les étiquettes ou verbalement, n’implique nullement qu’un bien soit

n’implique pas l’absence de tous autres défauts.
= Les lots en provenance hors UE (précédés d’un astérisque *) sont vendus sous le régime
de l’importation temporaire en France : une TVA à l’importation additionnelle de 5,5% du prix
d’adjudication sera prélevée en sus des frais habituels à la charge de l’acquéreur. Ces frais
additionnels seront remboursés à l’acquéreur sur présentation d’une preuve d’exportation
hors de l’Union européenne dans les délais légaux.

CONDITIONS OF SALE
= Taking part in the auction means full acceptance of the conditions of sale.
= The auction is to be paid in full. Buyers will pay the hammer price as well as transaction costs :
23% excl. taxes (27,6% incl. taxes)
= Clients not domiciled in France will not be able to claim their purchase until payment has
been confirmed in full.
= Delivery of the item may be deferred until clearance of payment.
= Buyers are advised to proceed with the claiming of their purchases as soon as possible to
avoid incurring handling and storage charges, which are their responsibility.
= The auctioneer is in no way held responsible for handling or storage. Buyers can obtain
information concerning the delivery and shipping of their purchases immediately after the
auction.
= An exhibition prior to the sale permits buyers to establish the condition of the items for
sale and thus, no claims will be accepted after the hammer has fallen.
Upon request, a “condition report” description may be obtained before the auction.
= Potential buyers are invited to examine the goods that interest them before the auction
and particularly during the exhibitions. The auction house Joron- Derem remains at the
disposal of potential buyers for supplying reports on the condition of lots.
= Description of lots leading to catalogues, reports, labels and verbal indications or
announcements are only the evaluation of Joron-Derem’s perception of lots and will in no
way constitute proof of the fact.
= The indications given by Joron-Derem about the existence of reparation work, of an
accident or incident affecting the lot are to facilitate the inspection by the potential buyer
but the buyer’s appreciation of the lot remains his own or that of his specialist. Absence of
any indication of the existence of reparation work, of an accident or incident affecting the
lot in the catalogue, the reports, on labels or indicated verbally, does not exempt that lot
from having a current, past or repaired defect. Equally, the mention of one defect does not
eliminate the existence of other possible defects.
= The auction is regulated by the French auctioneer’s guarantees in force at the time of
purchase. The size and weight are only given as an indication. Repairs carried out for general
upkeep are not indicated. No claim is accepted concerning the condition of the item under its
gilt, paint, lacquer or varnish. Relining, inlay work and varnishing are considered a means
of conservation.
= The same applies to keys, locks, bronze and iron works that may have been replaced at
some undetermined period and are not guaranteed.
The highest and last bidder will be the purchaser.
The Auctioneer and Specialists agree to follow all the buying orders that are given to them,
in particular by amateurs not able to attend the sale.
= In the case of being unable to attend, a buyer can give a bid form to the auctioneer.
The auctioneer refuses any responsibility as to the execution of the bid form.
= If you wish to bid by telephone, you must make the request at least two days before the
sale in writing or by fax with a cheque made out to Joron-Derem.
= As soon as the sale is over, the item will become the complete responsibility of the buyer.
= The buyer is entirely responsible for insuring his purchases and Joron-Derem refuses any
responsibility for damage occurring to the item once the sale has ended.
The exportation licence formalities may take from 5 to 10 weeks, but this delay may be
considerably reduced according to the rapidity with which the buyer instructs Joron-Derem.
= Any bidder is deemed acting on his own behalf except when prior notification, accepted by
Christophe JORON-DEREM SARL, is given that he acts as an agent on behalf of a third party.
= Any buyer in the European Community, subject to VAT, must indicate his VAT
identification number at the time of the sale, with a view to delivery in a member state and
he has 30 days to complete formalities.
= A non-European Community buyer must indicate at the time of the sale that he intends to
export the item and he has 30 days to provide the exportation justifications.
= The auctioneer refuses any responsibility concerning legal or fiscal consequences arising
from a false declaration made by the buyer.
= The buyer acknowledges :
= Becoming the owner and the person responsible for items as soon as the auction is over.
= Taking on the risks and fees of handling and storage.
= Delivery of the items takes place after full payment.
= Potential buyers can ask to examine the items that interest them before the auction and
particularly during the exhibitions.
= The Auction House Joron-Derem remains at the disposal of potential buyers for providing
reports on the condition of items.
= Description of lots leading to catalogues, reports, labels and verbal indications or
announcements are only the evaluation of Joron-Derem’s perception of lots and will in no
way constitute proof of the fact.
= The indications given by Joron-Derem about the existence of reparation work, of an
accident or incident affecting the lot are to facilitate the inspection by the potential buyer
but the buyer’s appreciation of the lot remains his own or that of his expert. Absence of

This additional import TVA will be refund if the lot sold leaves the EU.
= This English language translation is provided for your convenience. These conditions of
sale as drafted in the French language shall be the binding text. Any disputes concerning the
interpretation of these terms shall be subject to the jurisdiction of the competent French court.
